Terms of Service

These Terms of Service ("Terms") govern your use of the Postger platform ("Service") operated by Postger ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are using Postger on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. Eligibility

You must be at least 16 years old to use Postger. By creating an account, you represent that you meet this age requirement and that all information you provide during registration is accurate and complete.

2. Your account

You are responsible for maintaining the security of your account credentials, including your password and any two-factor authentication methods you enable. You are responsible for all activity that occurs under your account.

If you become aware of unauthorized access to your account, you must notify us immediately. We are not liable for losses caused by unauthorized use of your account when you have failed to maintain adequate security.

You may not share accounts between multiple individuals. Each person using Postger should have their own account with appropriate role and permission settings.

3. Service description

Postger is a social media management platform that allows you to schedule, publish, and analyze content across multiple social media platforms. The Service includes content creation and scheduling tools, approval workflows, a client portal, a unified inbox, analytics and reporting, media library management, team management features, and an API for programmatic access.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

4. Your content

You retain ownership of all content you create, upload, or publish through Postger, including posts, images, videos, captions, and ideas. We do not claim any intellectual property rights over your content.

By using the Service, you grant us a limited license to store, process, and transmit your content as necessary to provide the Service. This includes publishing your content to social media platforms on your behalf, displaying it within the Postger interface, and generating analytics based on its performance. This license ends when you delete your content or close your account.

You are responsible for ensuring that your content does not violate any applicable laws, third-party rights, or the content policies of the social media platforms you publish to. We do not review your content before publication unless you use the approval workflow feature.

5. Acceptable use

You agree not to use Postger to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property, privacy, or other rights of third parties
  • Distribute malware, spam, or deceptive content
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems
  • Circumvent rate limits, usage quotas, or other technical restrictions
  • Use the Service to harass, threaten, or harm others
  • Resell or redistribute access to the Service without our written permission
  • Interfere with the operation of the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on the severity of the violation.

6. Social media platform terms

Postger integrates with third-party social media platforms through their official APIs. Your use of those platforms through Postger is also subject to each platform's own terms of service. We are not responsible for changes to platform APIs, rate limits, or policies that may affect the functionality of the Service.

By using Postger to interact with YouTube services, you also agree to be bound by the YouTube Terms of Service. Your use of YouTube data through Postger is also subject to the Google Privacy Policy. You can revoke Postger's access to your YouTube data at any time through the Google security settings page.

If a social media platform revokes, restricts, or modifies Postger's API access, we will make reasonable efforts to communicate the impact to you, but we cannot guarantee uninterrupted access to any third-party platform.

7. API usage

The Postger AI Agent API is provided for programmatic integration with the Service. API keys are scoped to specific workspaces and permissions. You are responsible for securing your API keys and for all activity performed through them.

API access is subject to rate limits and usage quotas as described in our documentation. We may modify API endpoints, rate limits, or authentication methods with reasonable notice. Excessive or abusive API usage may result in temporary or permanent suspension of API access.

8. Billing and subscriptions

Postger offers Free, Pro, and Agency plans. All paid subscriptions are processed by Polar, which acts as our Merchant of Record. This means Polar is the legal seller of the subscription. Polar collects your payment, handles applicable sales tax and VAT, processes refunds, and manages chargebacks. By subscribing to a paid plan, you enter into a billing relationship with Polar and agree to their Terms of Service.

Paid plans are billed on a recurring basis (monthly or yearly). By subscribing, you authorize Polar to charge recurring payments at the then-current rate for your selected plan. Your payment details (credit card, billing address) are collected and stored exclusively by Polar. Postger does not have access to your full payment credentials.

Free trials, when offered, provide access to paid features for a limited period. At the end of the trial, you will be charged for the selected plan unless you cancel before the trial ends.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Refund requests are handled by Polar in accordance with their refund policy. If your payment fails, we may downgrade your account to the Free plan after a grace period.

We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing period.

9. Intelligence tools and credits

Postger's AI-powered intelligence tools (content scoring, channel benchmarking, and content gap research) operate on a credit-based model. Credits are included with certain plans and may be purchased separately. Credits are non-refundable and expire as described at the time of purchase. We do not guarantee specific outcomes from intelligence tool results.

10. Client portal

The client portal feature allows you to share content with external clients for review and approval. You are responsible for the content you share through client portals and for ensuring that your clients' use of the portal complies with these Terms. Client portal access links are workspace-scoped and should be treated as confidential.

11. Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

12. Intellectual property

The Postger name, logo, design, and software are owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written permission.

We respect the intellectual property rights of others. If you believe that content available through Postger infringes your rights, please contact us with details so we can investigate.

13. Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms. This includes any claims resulting from content you publish through Postger to third-party platforms.

15. Termination

You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms, fail to pay for a paid plan, or if we are required to do so by law.

Upon termination, your right to use the Service ends immediately. We will retain or delete your data as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including limitations of liability, indemnification, and governing law) will continue to apply.

16. Changes to these terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through a notice in the application at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance. If you do not agree to the updated Terms, you should stop using the Service and close your account.

17. Data processing and GDPR

We process personal data in accordance with the General Data Protection Regulation (GDPR) for users located in the European Economic Area (EEA), the United Kingdom, and Switzerland. Our legal bases for processing, your data subject rights, and details about international data transfers are described in our Privacy Policy.

Postger uses cookieless analytics (DataFast) on its website. This analytics tool does not place tracking cookies on your browser and does not build advertising profiles. 18. Governing law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved in the courts of Poland. If you are a consumer in the EEA, you retain the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights under applicable local law.

19. General provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Postger regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right. You may not assign or transfer your rights under these Terms without our prior written consent.
